Car Accidents on Route 102 fill the Londonderry Police Log this week

Police Log For 12/10/09-12/16/09

A car accident on Route 102 made authorities realize just how slick and impassible the road was. The accident was reported at 11:49 PM on December 13, and the road was subsequently closed to allow salt and sand to be spread. The road remained closed for approximately 45 minutes, reopening just after 12:30 AM on December 14. Most of Londonderry was lucky enough to be sleeping and never knew.

Police Car AccidentA marked police cruiser with its emergency equipment activated was struck by an oncoming car on December 10 at about 5:57 PM. That would have put the time of the collision after dark, reports from the scene indicate that the Officer did have his lights on. Officer Sean Doyle, the driver of the police car, was responding to a Domestic Disturbance call in the “Greek Gods” when he was traveling from the direction of the Londonderry Flea Market towards Crossroads Mall on Route 102. He began taking the left hand turn onto Acropolis Drive and was struck on the passenger side by a 1997 Chevy pickup truck. A 25 year old female was driving the truck, and it was also reported that there was one juvenile in the truck. At least one injury was reported from the occupants of the truck, and the officer did not receive any. “Because the officer was responding to an emergency call, the Londonderry Technical Accident Reconstruction (TAR) team was called in to investigate the accident. The accident remains under investigation as to cause.”

In that story the mother indicated that her son is not OK, His face is unrecognizable,” she said. “He is embarrassed to even go to school.” The child was wearing a lap belt and a shoulder belt, his mother also told the reporter. Oil Truck and Pickup Truck Accident On December 17, at 12:50 AM a caller via 911 reported a car accident on Route 102. Upon arrival, police found an empty Fred Fuller Truck and a Ford pickup truck. After an investigation, it was determined that the pickup truck was traveling west, the tractor trailer traveling east. The pickup truck entered the eastbound lane and collided with the tractor trailer truck. The driver of the Fred Fuller truck was uninjured, but the pickup truck driver was transported to Southern New Hampshire Medical Center in Nashua. The pickup truck driver, Jason Babbidge, was arrested at the Medical Center at 3:50 AM for Driving Under the Influence. This two car accident involved a Londonderry Police officer responding to the scene of a domestic disturbance, who was then struck by another vehicle, a 1997 Chevy pickup truck. The marked police cruiser, a 2007 Ford Crown Victoria, with emergency equipment activated, was eastbound on Route 102 and was turning north onto Acropolis Drive when it was struck on the side by a westbound vehicle on Route 102. Minor injuries were reported by at least one occupant of the other vehicle, which contained the operator and one juvenile; the police officer was not injured. Because the officer was responding to an emergency call, the Londonderry Technical Accident Reconstruction (TAR) team was called in to investigate the accident. The operator of the other vehicle was Amanda Trombley, age 25, of Derry, NH. The officer driving the cruiser was Officer Sean Doyle, age 26, of Londonderry, NH. I, Detective Patrick Cheetham, being duly sworn, herewith make application for the issuance of an arrest warrant against the defendant:
Defendant’s Name: Alexander Cavedon

I have information that the crime of forgery has been committed by the defendant as follows: (describe source, facts indicating reliability and credibility of source, and nature of information; if based in personal knowledge, so state):
1. I, Detective Patrick L. Cheetham, do hereby depose and say: I am a full-time police officer and detective with the Londonderry, NH Police Department, where I have been employed as a police officer for more than 7 years. I was graduated from the 129th session of the NH Police Academy and hold a Bachelor of Arts degree in Criminal Justice. I am also a polygraph examiner having been graduated first in my class from the New England Polygraph Institute, which is an eleven week, 440 hour course of instruction. I have been a field training officer with the Department for more than 3 years and am currently assigned to the Londonderry Police Department’s Detective Division. I have made numerous misdemeanor and felony arrests and have investigated numerous burglary cases. I am investigating a burglary case, the facts and circumstances of which are as follows
2. On Saturday August 15, 2009 I responded toXXX Preserve Drive for a residential burglary alarm. Arriving on scene a few minutes later, I approached the residence after parking my police cruiser down the street. As I approached the home, I saw and heard a vehicle running in the driveway across the street. The vehicle was a black Toyota Solara with high end brake lights. I did not see the license plate of the vehicle and it drove away as I approached xxx Preserve Drive.
3. Officer Balukonis also responded to this alarm to help me check the residence. I found each door and window to be locked. Dispatch told me via radio that the alarm came in as “glass break.” From my training and experience, I know that this type of alarm can be the result of someone banging on a window or door or trying to gain entry through a window or door by force.
4. While checking the residence, I ascended the rear porch and checked the door that leads into the kitchenette. The door was locked but there was an impression in the door’s frame and a mark on the glass itself. At the time, I noted the marks and continued checking the remaining parts of the home. After checking the residence, I spoke with a neighbor who was mowing his lawn. He said that he too saw the black Toyota and further stated that it had been parked at the end of his street prior to my arrival. He also said he saw two men who appeared to be in their late teens or early twenties walk down the street and back to their car.
5. He did not see if they went to a certain house but took note that they parked at the end of the street because it was late in the day and he does not normally see vehicles parked at the end of the street. I then remained on Preserve Drive for about 10 minutes or so to see if the vehicle returned. After waiting and not seeing the vehicle, I began to drive on Wiley Hill Road towards High Range Road. When I did, the same black Toyota Solara passed me heading towards Litchfield, NH. I reversed my direction to catch up to the vehicle but I could not find it. There was a very short time delay between seeing the vehicle and turning on it which indicated to me that the vehicle accelerated away from me at a high rate of speed because I could not catch up to it.
6. I then returned to Preserve Drive after checking the area for this black Toyota. When I returned to Preserve Drive, the neighbors to no. XXX were in their driveway. They again told me that they did not know who was in the black Toyota Solara nor do they know anyone who drives such a vehicle. They then asked me to check no. XXX Preserve Drive with them as they had the garage door and alarm codes. We then checked the residence again. These neighbors told me that they spoke with the homeowners on the telephone and learned that they once set off the glass break alarm when one of their children hit the window with a hockey stick. They also reported via telephone that this type of alarm does not come in very often (if ever) unless someone or something hits a window or door very hard and more than a simple “knock.” This neighbor resides at XXX Preserve Drive and identified himself as Sxxx. It was in their driveway that I initially saw the black Toyota Solara.
7. After checking the interior of the residence, I left and drove down Preserve Drive towards Wiley Hill Road. When I did, I saw a young man with blond hair running down the road. He was not wearing a shirt and had blue jeans rolled up to his knees. He was also wearing white sneakers. As I drove by him, I recognized him to be Sean Koehler. I have arrested Koehler before and also knew that he is a suspect in several residential burglaries. I also know that he has suffered from substance abuse in the past and that he is suspected of committing these residential burglaries to sustain his “drug habit.” I then pulled over and spoke with Koehler. My emergency lights were not activated and I did not prevent him from leaving.
8. He then told me that he was in the area and “out for a jog.” The weather at the time was extremely hot and humid and the clothing he was wearing was not clothing someone would normally wear when running for exercise. He initially said that he ran from home, which I know is a significant distance away from Preserve Drive. I questioned him about being in a black Toyota Solara and he then said that he was dropped off in the area by a friend named “Alex.”
9. When asked what Alex’s last name was, he said “Pappas” or “Cavedon.” I asked him again and he said “Cavedon” and that he has a black Toyota. I asked Koehler if he and Alex went to anyone’s house on Preserve Drive and he said that he stopped by his friend’s house on Preserve Drive but that he was not home. His said his friend’s name is “Robby” Codagnone and lives on the left side of the street. Koehler said that he wanted to go for a run so he told Alex that he would be all set and could leave. Koehler was unclear as to how he would have got home. He said that he would have either called his mother or Alex for a ride. I asked him if he had a cell phone on him and he said “no” and that he would have run to the Crossroads Mall to call for a ride.
10. Based on my training and experience as an investigator and polygraph operator, Koehler demonstrated both physical and verbal signs of deception in his story; he did not make eye contact when he spoke with me, his clothing did not match that of someone who would be exercising in such hot weather, and he lied to me initially about why he was in the neighborhood. He also did not know Alex’s last name and he initially said that he ran from home and was not dropped off in the area.
11. Koehler also told me that Alex or his (Koehler’s) mother was supposed to pick him up after he went for his run but that he did not tell Alex specifically where he would be or when. Koehler was not anywhere near his home and it would have been a very long distance to run home from Preserve Drive. Koehler’s story of why he was in the neighborhood continued to change as I confronted him about the alarm. He also did not know if his shirt was on the side of the roadway or if it was in Alex’s car.
12. I continued to speak with Koehler who changed his story and told me that he and “Alex” went to a friend’s house on Preserve Drive but that he was not home. I asked him if his friend lived at the end of the cul-de-sac on the right (the location of the alarm) and he said “no.” He further said that his friend was not home so they did not stay in the area nor did they go to any other house on the street and that his friend’s name was “Robby” Codagnone.
13. While speaking with Koehler, I could smell the odor of an alcoholic beverage coming from his person. He denied consuming any alcohol and consented to an HGN field sobriety test. I performed the test and observed a lack of smooth pursuit in both eyes as well as a distinct nystagmus at maximum deviation. His eyes were also red and bloodshot.
14. Just after I performed the HGN test, a black Toyota Solara drove down the street and pulled into the driveway to a residence across from where I was speaking to Koehler. I asked Koehler if that was his friend and he said “yes.” I then arrested Koehler for unlawful possession of alcohol (internal possession) and secured him in my police cruiser.
15. Officer Balukonis, who was also on scene, stopped this vehicle after it pulled out of the driveway and reversed directions. The vehicle was driven by Alexander Cavedon and was a black Toyota Solara. While in the home’s driveway, I heard a car horn honk as if to signal to someone inside the house to come out. No one came out of the house.
16. I then went over to Officer Balukonis and spoke with Alexander Cavedon. Alex told me that he and Koehler went to a friend’s house on Preserve Drive and that they parked at the end of the street. He initially lied about their intent for going to Preserve Drive in that he finally told me that they wanted to “party” and drink alcohol either at their friend’s house or in the trails at the end of Preserve Drive. I told Cavedon about the residential alarm to which I responded and he said that Koehler told him that the friends they were looking for also had friends who lived at XXX Preserve Drive. He said that he and Koehler went to the front door, knocked, and waited. No one answered so Koehler suggested that they go around to the back of the residence to see if anyone was home.
17. Cavedon stated that both he and Koehler went around to the back of the home but only Koehler ascended the porch stairs and knocked on the rear porch door. This door was locked and leads directly into the home. He initially said that Koehler only knocked on the door and looked into the window. After I confronted him about the glass break alarm and the manner in which it was “tripped,” he said that Koehler actually used his knee against the door and applied more force than necessary to simply knock on the door. In his written statement, Cavedon stated that Koehler “attempted to enter the house with extra force using his body.” He also said that Koehler did this multiple times.
18. Cavedon also admitted that Koehler had been drinking and that he threw several beers into the woods at the end of the street and that the beers were from his trunk. Cavedon consented to a search of his vehicle, in which Officer Balukonis found a marijuana pipe, beer, and a scale that I recognized to be commonly used for weighing drugs. After speaking with Cavedon, Officers Balukonis and Bellino checked the wood line but were unable to find Koehler’s shirt or the beer. Based on the evidence and witness statements, I also charged Koehler with attempt to commit burglary for trying to gain access into the home located at XXX Preserve Drive with the intent to commit a crime therein.
19. On August 17, 2009 I telephoned Cavedon and asked him if he would come to the police station to speak with me further. He said that he would come in right away and arrived at about 1:25 pm. He sat with Det. Dyer and me in the station’s lobby interview room. I told him that he was not under arrest, free to leave at any time, and the door was closed only for our privacy and that it was not locked. He said he understood and would speak with us.
20. He then provided a similar account about what occurred on Preserve Drive on August 15 but with some discrepancies. He now told me that he actually went onto the stairs leading up to the porch at XXX Preserve Drive and that Koehler did not actually use his knee to apply force to the door but instead used his upper body and shoulder area. He would not say that he thought Koehler’s intent was to get into the house but did say that they were looking for a place to party, which implied that they would have entered if Koehler was able to open the door. Cavedon also stated that once the alarm sounded, he said that they should leave and that they walked back to his car. When questioned further about this, he said that they “took off” to his car and that he would not have entered into the home if Koehler was able to open the door. Based on my training and experience, when someone uses the term “take off” it usually means that they were trying to leave because they did something wrong and not just a term used to mean that someone merely left.
21. I also questioned Cavedon about anything else that he and Koehler did that afternoon. Cavedon then stated that he picked Koehler up at his residence at around 12:00 pm and drove him to a pawn shop for gold in Derry, NH. Cavedon said that Koehler sold some jewelry that he got from his (Koehler’s) grandmother. After leaving the pawn shop in Derry, Cavedon said that they went to Cavedon’s house at 25 King Charles Drive. After hanging out at his house, they left because Cavedon’s parents were coming home and his mother does not like Koehler.
22. After leaving, they went to Preserve Drive to see if “Robby” Codagnone was home. He said that they both went to Codagnone’s house but parked down the street instead of driving into the driveway. When asked why he did this, he said that Codagnone’s father might not want them partying at his house so they did not want to drive into the driveway. This did not make sense to me and Cavedon said that maybe “Robby” would have gone with them into the woods to party. Cavedon said that partying meant drinking beer and smoking marijuana.
23. I did not question Cavedon further about Codagnone’s house but he said multiple times that both he and Koehler went up to the house and knocked on the door without answer. After seeing that no one was home at Codagnone’s house, they decided to walk to another friend of Koehler’s, who reportedly lived at the end of the cul-de-sac on the right. This is the home to which I responded for the alarm dispatch on August 15, 2009 at about 6:00 pm.
24. After sounding the alarm, they “took off” back to Cavedon’s car. Cavedon stated that Koehler was in the car at the time when he drove past me. Cavedon also admitted to seeing me drive past him on Wiley Hill Road and continued down the road to West Road. He then returned to Preserve Drive to drop off Koehler because Koehler wanted to get the marijuana he left in the woods. Cavedon admitted lying to me about what was left in the woods because he did not want to get Koehler in trouble for marijuana possession.
25. Cavedon said he returned to Preserve Drive a third time to pick Koehler up, who asked that he return in 10 or so minutes. Cavedon said that he did not drive his car down the street again because Koehler wanted to walk himself. He also admitted to pulling into the neighbor’s driveway upon seeing me speaking with Koehler on the street and to honking his horn in the driveway. He said he did this to make the police think that he knew someone at that house when in fact he did not know the homeowner’s at all.
26. Before Cavedon left, he again stated that he did not know anything else about what he and Koehler did that day and that he was telling the complete truth. Cavedon then left the station and Det. Dyer and I went to Preserve Drive too look for Koehler’s shirt and to speak with the homeowner’s at XXX Preserve Drive.
27. Mxxx, who lives at XXX Preserve Drive, was home and invited us in. She allowed me to again look at the back door and porch. When we did, Det. Dyer inspected the marks on the doorway and noticed a propane tank on the deck near a gas grill. He compared the bottom of the propane tank to the marks on the door and they were a match. I did not put “two and two” together when I responded to the alarm on August 15 but after looking at the marks again and inspecting the propane tank, there was no doubt in my mind that Koehler or Cavedon used the propane tank to smash the door. The tank also had white paint transfer on its bottom that matched the paint on the door frame and there were also paint chips on the door frame. Mxxx confirmed that the damage was new and that she had never seen it before.
28. I took the propane tank as evidence and later processed it for fingerprints and paint comparison. I fumed the tank and lifted several distinct prints. I also scraped off some of the transferred paint and collected the scrapings in a plastic jar.
29. Det. Dyer and I also spoke with the neighbors at XXX Preserve Drive again. Gxxx again told me that he did not know the people parked at the end of his street nor does he know anyone who drives a black Toyota Solara. He checked the wood line around his property but did not find a shirt or anything else out of place. He did say that he saw one of the men near the rock wall at the cul-de-sac. Det. Dyer and I checked the rock wall but did not find anything in or around it.
30. We then went to XXX Preserve Drive to speak with the Codagnones. An in-house records check confirmed that the police department has a Robert Codagnone listed as living at that address. I knocked on the front door and rang the door bell but no one answered. Det. Dyer went around the back of the house to see if he could find anyone. When he did, he saw that there is a glass sliding door that leads into the basement. He also saw a mark on the glass that looked as if someone had hit it with a rock.
31. He then checked the door and found that it was closed but unlocked. I then inspected the door and came to the same conclusion and looked around on the ground for a rock or instrument that could have made this mark. I saw half of a brick on the ground. The brick had fresh chips in it and its size matched the marks on the sliding glass door. I continued around the residence and found a broken basement window on a separate side of the home.
32. The window was a small, basement window and the glass was shattered. When I looked closer, I saw a distinct sneaker pattern in the second window pane that was not broken. It had a concentric circle and said “NIKE.” We located the homeowner, Rxxx, who came back to his home from work. He said that his daughter often lets the family pet out of the basement slider and may have left it unlocked. He inspected the damage to the slider and to the window and said that the damage was new and that he had not noticed it before. Rxxx also said that he purchased the home from the Codagnone’s about one month ago and has only been in the home since that time.
33. Both he and his family were not home on Saturday night but he suspected that the house alarm was turned on. The police department did not receive a house alarm for XXX Preserve Drive on August 15, 2009 so I suspected that no on entered into the home. The house was alarmed on August 17 when Det. Dyer and I went to the residence because we set off the audible alarm when we entered into the basement. Rxxx checked the interior of his residence with us and did not notice anything missing or out of place. On August 18, 2009 Det. Dyer confirmed with Lxxx, that the alarm was activated on Saturday night so we do not suspect that anyone gained entry into the home.
34. I removed the window pane with the shoe impression and brought it back to the station. Det. Dyer took the brick back as evidence as well. We also photographed the damage and window pane before removing them. Based on the evidence at hand, I applied for a search warrant to seize Sean Koehler’s sneakers for comparison to the shoe impression left on the described window pane.
35. Det. Dyer and I then returned to the station and logged the evidence. On August 18, 2009, I applied for and was granted a search warrant to seize Koehler’s sneakers from the Rockingham County Jail. After seizing his sneakers and a DNA sample, I returned to the station and compared the bottom of Koehler’s sneakers to the shoe impression left on the window pane; they matched.
36. I then telephoned Cavedon and asked him if he would come to the station to speak with us again. He consented and came directly to the station from his residence. While speaking with him in the lobby interview room at about 4:00 pm, I again told him that he was not under arrest, free to leave at any time, that the door was closed only for our privacy and that it was not locked. He said he understood and would speak with us.
37. I asked him if there was anything else that he wanted to tell us about the attempted burglary at XX Preserve Drive and he said “no.” I confronted him with the new evidence and he continued to deny seeing Koehler smash the propane tank against the door stating that he was not looking at Koehler and he was distracted because he was looking around the yard. After telling him that I did not believe him, he finally admitted to seeing Koehler hold the tank under his arm and smashing it against the porch door. After one hit from the tank, the alarm sounded and the two left.
38. I then asked Cavedon about XXX Preserve Drive and if there was anything else he knew about what happened there. He said that they only knocked on the door. After confronting him about the broken basement window and the marks on the sliding glass door, he only admitted to seeing Koehler kick the window and break it. He denied seeing this several times before finally admitting to it. He said that he was not in “right state of mind” and that he had been drinking. Det. Dyer asked him how many beers he had consumed and he said 3-4. I told him that I did not smell any odor of an alcoholic beverage coming from his breath when I spoke with him on Saturday night and he shrugged his shoulders.
39. He said several times that he was “not a bad kid” and just made bad decisions that night. He also changed his statement regarding XXX Preserve Drive in that he now stated that he thought that Koehler was trying to break into the house after we spoke about XXX Preserve Drive. He repeatedly said that he would not break into someone’s home and that Koehler did everything and that he was just merely there when it happened.
Based upon the foregoing information, there is probable cause to believe that the defendant did commit the crime or offense as stated above. Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the defendant and bring him/her before the court having jurisdiction.

I, OFFICER JASON G TEUFEL , being duly sworn, herewith make application for the issuance of an Arrest warrant against the defendant:

I have information that the crimes of Theft by Unauthorized Taking, two counts, have been committed by the defendant as follows:
1. On October 9, 2009 at 1531 hours, I responded to Movie Scene, 123 Nashua Rd., Londonderry, for a theft report. The reporting party, Axxx (XX/XX/XXXX), xxx for Movie Scene, said a book of lottery tickets was stolen from their store and some of those tickets were recently redeemed at various locations in New Hampshire.
2. On October 9, 2009, Axxx was informed by NH Lottery Sales Representative, Bxxx (XX/XX/XXXX), that a book of lottery tickets was missing from the Londonderry store. Upon further investigation, one of the tickets from the missing book was redeemed in the store on October 8, 2009 at 2041 hours. Axxx reviewed the tape and saw a young male cash in the ticket. The employee who cashed the ticket for the suspect was Mxxx. Axxx asked Mxxx if he recognized the suspect and he said no.
3. Axxx said the lottery books are kept in the office and may have gone missing at any time since the book was received on July 20, 2009. April said she didn’t recognize the suspect as an employee, but said they are investigating the matter internally. Axxx also said Movie Scene is held liable by the NH Lottery for the repayment of the lottery tickets and redeemed cash.
4. Bxxx said she was at the Londonderry store on a routine lottery visit. She told me Game #650, a $5.00 book of tickets named Funky 5 (Book #5282), which was coming off sale, was to be turned back into the lottery. She requested the store manager, Jxxx retrieve it. Jxxx told her the book was missing.
5. Bxxx printed a lottery report on ticket book #5282, which showed it had been activated and was on sale. However, the book was not in the lottery machine. Bxxx called her headquarters and they ran a report showing the history of book #5282. According to the report, the book was activated on October 8, 2009 at 2041 hours. Bxxx said no one at the store at that time had the capability of activating the book.
6. 7. Axxx tried to print or record their video surveillance of the suspect, but was unsuccessful. Later, I went next door to Quik Stop, and spoke with a manager there. I called the 7-Eleven in Nashua, and they did not have any video before October 20, 2009. I attempted to call the 7-11 in Litchfield, but could not make contact with anyone. I asked Axxx exactly where the lottery tickets are stored. She said they are stored in the office. The office door is locked. She said book #5282 could’ve been stolen anytime between July 20, 2009 to October 8, 2009.
8. I asked Bxxx how a book of tickets are normally activated. She said the NH Lottery ships the tickets via UPS. The store receives the ticket books and scans the invoice through the yellow lottery terminal. This action puts the ticket book into “received mode,” meaning the store received the ticket book. The ticket book is still inactive until someone with the proper authority can activate it. Bxxx told me there is a way an inactive ticket book can be activated without the proper authority handling it. She said this method is kept confidential.
9. Bxxx explained the first ticket from the stolen ticket book was redeemed on October 8, 2009 at 2041 hours at the Londonderry store. This allowed the suspect to then redeem the rest of the winning tickets at area stores. Bxxx said the ticket book was a 37% redemption rate in under 24 hours, which is very high for such a low volume store. To her, this indicated fraud. I asked Axxx who handles the lottery tickets in the Londonderry store. She said, Store Manager Jxxx (XX/XX/XXXX).
10. On October 9, 2009 at 1756 hours, I spoke with Jxxx in the lobby interview room at the station. I told her she was providing a voluntary statement and was free to leave at any time. The interview room door was closed for privacy, but not locked. Jxxx was aware she was being interview about a theft of lottery tickets from Movie Scene and the redemption of those tickets. Jxxx said she was terrified and uncomfortable about being interviewed. Her demeanor was calm and she appeared confused as to why she was being singled out for an interview. I observed her hands were shaking. I went through her background and biological information, which is including in this report. Jxxx lives with her boyfriend, Sxxxx, who was laid off from work.
11. Jxxx began the interview by telling me she was the store manager, who supervises approximately eight to ten people. She provided me with her work schedule and the last time she worked, which was October 7, 2009. She was off on October 8, 2009. I asked her to explain how she stocks the lottery tickets. She explained exactly what Bxxx told me about the shipping/receiving process. However, she said there was a missing key to the lottery machine, which she believes went missing approximately a month ago. She explained she had attended a lottery class and is aware of how a ticket book is activated. She said the lottery tickets are kept in a locked office. She told me she has retrieved lottery tickets before, but only with permission of the store owner. She also mentioned a store employee, Rich Cautela, who also has a key to the store, recently quit without notice. She believes he could be a suspect.
12. Jxxx provided a three page statement on what happened on October 9, 2009. She explained Bxxx from NH Lottery came to the store on a routine visit. She also explained her conversation with Bxxx how she could not find the ticket book. Jxxx watched the surveillance footage with Bxxx, which showed the cashier, Mxxx cashing in his own $1.00 ticket at approximately 2038 hours. At approximately 2040 hours, the suspect came into the store and stood by the lottery machine. Mxxx checked in a movie for another customer before redeeming the lottery ticket for the suspect. Bxxx thought the suspect looked like a pizza delivery boy. Jxxx reviewed the surveillance footage with Axxx and thought it could be someone they knew. They decided it was not. Jxxx said the suspect looked like at least six people she helped on October 6, 2009. She was told to question Mxxx about the incident when he came in the next shift.
13. On November 14, 2009 at 1520 hours, I spoke with Richard Cautela (6/27/1990) in the lobby interview room at the station. I told him he was providing a voluntary statement and was free to leave at any time. The interview room door was closed for privacy, but not locked. Richard was aware he was being interview about a theft of lottery tickets from Movie Scene and the redemption of those tickets.
14. Richard appeared calm and composed. I focused the majority of my questions on his employment with Movie Scene and the circumstances regarding why he quit. Richard said he had worked at Movie Scene for approximately two years. More recently, Richard said he continually asked Jxxx for more work hours. His request was denied. He told me there was a point where he was working two hours a week. He also noticed a new employee was hired and that person, with less experience, worked more hours than he did. Furthermore, Richard felt like he deserved more and was fed up with making minimum wage. On September 26, 2009, Richard was scheduled to work and did not show up. He told me he quit without notice.
15. Next, I asked him the following: Do you know who did this? “No.” Who do you suspect? “No one, but if you want me to choose someone I will.” Who can you clear? “Jxxx.” Who do you think had the best opportunity? “Possibly J? Friday nights the corporate office is open, but Lxx and Bxxx are in there.” Who’s the first person you told about this/what did they say? No answer. How do you feel about being interviewed about this? No answer. Have you ever thought about doing something like this? “Thought about taking a movie I really wanted, but never did. However, I did checkout more than three movies, which is against company policy.”What’s your theory on how this happened? “Someone must’ve left the door unlocked.”Why do you think the victim said you did this? “Left at the wrong time, had a key, about it.”What type of person would do this? “Desperate.” Think there’s a good reason for this? What is it? “None.” Why wouldn’t you do this? “It’s not worth going to jail. I could care less about the job.” What should happen to this person if they are caught? “Judge’s job.” Should this person be able to apologize? “Yes.” Ever happened to you before? “No.” Is there anything you thought I would ask you that I didn’t? “Not really.” This concluded my interview with Richard.
16. On November 17, 2009, Richard left a voice mail message stating he wanted to come to the station and talk with me. On November 19, 2009 at 1448 hours, Richard came into the station for second interview. I spoke with Richard in the lobby interview room. I told him he was not under arrest and free to leave at anytime. He interrupted me and said, “I know. I came to tell you I did it.” Richard explained the lottery tickets were on the counter at Movie Scene and he took them. Richard said he didn’t remember exactly when he took the tickets, but it was sometime between August and mid-October. Recently, he had his friend cash the first ticket, while he stayed in his vehicle. Then, he drove to the rest of the locations to cash the remaining tickets. Richard said his friend was unaware he was cashing a stolen lottery ticket. I asked Richard to explain why his friend didn’t question cashing his lottery ticket, while he waited in the vehicle. Richard said he plays the lottery a lot. He said his friends know that he hoards tickets and then they all cash them together. I asked Richard if he wouldn’t mind writing a statement to these facts. He agreed.
17. Richard wrote a few months ago, August to mid-October, he worked an opening shift at Movie Scene. He noticed a sealed pack of $5.00 scratch tickets next to one of the registers. Richard put them in his pocket and left the store with them at the end of his shift. He stated he scratched them that day, but did not have the intention of cashing them. Approximately one month later, he decided to see if the winning tickets he scratched could be redeemed for cash. He stated he had his friend James Burnham, cash the first few tickets. In total, approximately $150.00 was redeemed. Richard stated he lead James to believe he had been hoarding tickets, which was not uncommon behavior for him. Richard did not sell any tickets or give James any money. Finally, Richard knew the way to activate the lottery tickets. Richard concluded his statement by stating, “I didn’t admit my crime because I wanted a reprieve from law officials; I needed to express my guilt for hurting genuinely good people such as yourselves [Movie Scene employees]. I sincerely apologize and will gladly say so in person.”
Based upon the foregoing information, there is probable cause to believe that the defendant did commit the crime or offense as stated above.
Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the defendant and bring him/her before the court having jurisdiction.
