Supporting Affidavit For Request To Issue Arrest Warrant
INSTRUCTION: A person seeking an arrest warrant shall appear personally before any justice or justices of the peace, and shall give an affidavit in the form hereinafter prescribed. The affidavit shall contain facts, information and circumstances upon which such person relies to establish probable cause for the issuance of the warrant, and the affidavit may be supplemented by oral statements, under oath for the establishment of probable cause. The person issuing the warrant shall retain the affidavit and shall make notes personally of any oral statements under oath supplementing the affidavit or arrange for transcript to be made of such oral statements.
PROBABLE CAUSE IS DEFINED AS: “An apparent state of facts found to exist upon reasonable inquiry, which would induce a reasonably intelligent and prudent (person) to believe, in a criminal case, that the accused person had committed the crime charged.”

I, OFFICER JASON M ARCHAMBAULT , being duly sworn, herewith make application for the issuance of an Arrest warrant against the defendant:

I have information that the crimes of Indecent Exposure and Lewdness have been committed by the defendant as follows:
On 10/21/09 at approximately 1753hrs. I responded to the area of 44 Kendall Pond Rd. for a report of suspicious activity. Dispatch advised that the caller reported a male subject in the woods near the apartments at 44 Kendall Pond Rd. who was watching children outside playing. The caller told Dispatch that when he yelled at the subject to get out of the area he fled on foot. The subject was described as a male possibly 30 years old, with brown hair, glasses, and wearing a black jacket. I arrived at 44 Kendall Pond Rd. shortly after and started checking the area. At approximately 1803hrs. I found a male subject, matching the description given, walking eastbound on South Rd.. The subject was walking towards the opposite direction of the Kendall Pond Rd. apartments. I stopped on the side of the road and met with the subject. I identified him as Michael Jones DOB 09/16/84. I asked Jones where he was coming from and he stated he was coming from home. He stated that he lived on Bayberry Ln.. I asked him where he was going and he said Crossroads Plaza. I told him he was going away from Crossroads plaza if he continued in the direction he was heading and he seemed confused. I asked him if he knew where he was and he said he was in Londonderry. I asked him if he knew what street he was on and whether he knew which direction it would take him and he said he did not. I asked him if he had been near the Kendall Pond Rd. apartments and he said he had walked by that way earlier. I asked him if he stopped there and had been standing in the woods. He seemed confused again and said he didn’t know. He told me he was just walking and he walks alot. I told him that people were complaining that a man that looked just like him was in the woods near the Kendall Pond Rd. apartments and was touching his leg in what appeared to be an inappropriate way. Jones stated that he wasn’t doing that. I noted at this time a truck stopping on the side of the road near where I was speaking with Jones. I told Jones to stay at the front of my cruiser while I spoke with the other subjects in the truck. I told him he was being detained until I could obtain more information from him. He said he understood.
I walked over to the truck, and the driver and passenger stated that they called the police about Jones. I identified them as Dana Larock DOB 02/26/69 and Dan Grimard DOB 01/01/72. Larock and Grimard stated that while standing outside they and Larock’s brother, Michael Finley DOB 04/29/71, saw Jones in the woods near their apartment. They said that it seemed like Jones was watching the nearby children outside playing. Grimard and Larock also said that they saw Jones rubbing his leg in what seemed like a self gratifying way. I asked where on Jones’ leg he was rubbing and they said his inner mid-thigh. I told them I would speak with Jones more and attempt to get further information from him. While saying this, Grimard and Larock stated that Jones was leaving. I turned around and saw Jones walking back towards Kendall Pond Rd.. I shouted for him to get back to the front of my cruiser and he slowly turned around and walked back. I told Grimard and Larock that they were all set to leave and they did. I then returned to my cruiser to speak with Jones again.
I asked Jones if he remembered me telling him to stay at the front of my cruiser and he said he did. I then asked him why he was walking away and he said he had to go to the bathroom. I asked him if he had any medical conditions or took any medications and he stated that he was schizophrenic and took medications for it. I then asked him about whether he was touching himself inappropriately and he said he was not. I told Jones to stay away from the Kendall Pond Rd. apartments. He told me would. With no further evidence of a crime I then allowed Jones to continue walking to his destination.
On 11/02/09 at approximately 1430hrs. I spoke with Sgt. Parsons at roll call. He asked about this case and advised me that Ofc. Warriner had investigated a similar case of an unknown subject standing in the woods near South School. The subject was not found. I was then told that the witnesses from this case were also involved in Ofc. Warriner’s case. I read Ofc. Warriner’s Field Interview report and learned that a subject, possibly Jones, was watching two children walking to school. The subject alarmed and frightened the children. Larock is the children’s uncle and he notified Ofc. Warriner of this case and what it entailed. I was then notified by Sgt. Parsons that the witnesses from this case had more information for me and to contact them to retrieve it.
I then made telephone contact with Larock. I asked him about the information he had for me and he told me that both him and Finley saw Jones again after I spoke with him on 10/21/09. I told him that I was aware of that. I asked him if Jones had been caught in the woods again and he said no. He said they saw him walking up Kendall Pond Rd. towards Crossroads Plaza, which had been his destination that night. Larock said that when Finley and him saw Jones they yelled at him to get out of the area. Jones continued on his way up Kendall Pond Rd..
I asked Larock to come into the station as soon as possible to fill out a statement form describing the incident. He said he would come in on 11/03/09 to do so. The phone call was then ended.
I then contacted Finley and asked him to come in as well to fill out a statement form. He said he would on 11/03/09 and Grimard would come with him. Finley also stated that he had seen Jones rubbing his crotch in the woods on 10/21/09. He told me that Jones was not exposing himself but was rubbing his crotch in a way that made him think that Jones was masturbating. Once all information was obtained from Finley this call was then ended.
On 11/03/09 at approximately 1814hrs. I arrived at 44 Kendall Pond Rd. to get statements from Grimard, Larock, and Finley. They had called the station earlier to inform me that it would be easier for them if I came to their home to retrieve the statements. Once inside the building, I met with the three men.
I obtained statements from Finley, Larock and Grimard. In the statements each witness described seeing Jones in the woods rubbing his crotch as if masturbating while watching the children who were playing outside near them on 10/21/09.
Finley wrote in his statement that Jones had returned to the area of 44 Kendall Pond Rd. a short while after my meeting with him on South Rd.. Finley wrote that he asked Jones why he was playing with himself in the woods and Jones replied that he likes to play with himself. Finley then told Jones to get out of the area. Jones complied and continued walking northbound on Kendall Pond Rd.. Grimard and Larock confirmed that Finley’s conversation with Jones took place and was accurately described.
Once all statements were obtained, I cleared the apartment building. All three statements were included in this report.
On 11/03/09 at approximately 1930hrs. I contacted Larock in an effort to learn how old the children were who were outside playing while Jones was in the woods near the home. He answered the phone and advised me that his son, Robert Larock DOB 03/22/04, and his niece and nephew were all outside that day. He then put his sister, Eleanor Fatica DOB 09/05/68, on the phone. She told me that she was the mother of Larock’s niece and nephew. She told me her children were both ten years old. She stated her children’s names were Danielle Carmer DOB 07/19/99 and Dylan Carmer DOB 07/19/99. Once all information was obtained from Fatica and Larock the call was then ended. An arrest warrant will be pending for Jones for “Lewd Conduct” charges.
Based upon the foregoing information, there is probable cause to believe that the defendant did commit the crime or offense as stated above.
Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the defendant and bring him/her before the court having jurisdiction.

I have information that the crime of False Imprisonment has been committed by the defendant as follows: (describe source, facts indicating reliability and credibility of source, and nature of information; if based in personal knowledge, so state):
I, Officer Daniel Perry, do hereby depose and say: I am a police officer with the Londonderry, New Hampshire police department, where I have been employed as an officer for more than one year. I am a graduate of the New Hampshire police Academy, I am investigating a case of suspected false imprisonment, that facts and circumstances of which are as follows:
1) On February 02, 2008 at approximately 1835 hours, while on patrol I was dispatched to 133 West Rd to investigate an assault complaint that had allegedly happened at 1630 hours.
2) Upon arrival at 133 West Rd, I spoke to the complainant and identified her as Holli Durret. Holli informed me that she had been assaulted by her daughter Samantha Felch and her daughters boyfriend Hari Ramos. Holli stated that Samantha and Hari live with her and her husband, and are both heroin addicts. Holli stated that she has been trying to get Samantha help, and has been trying to keep her away from going out to buy more drugs. Holli stated that Samantha wanted to leave the house today to go buy more drugs, and became upset when Holli tried to persuade her not to go. Holli stated that Samantha became combative and bit Holli on her arms and hands. Holli stated that Samantha had wrestled her to the ground, then kicked her in the head at least three times. Holli stated that after she was kicked, Hari grabbed her and would not let her go, restraining her from going outside and trying to stop Samantha from leaving. A struggle ensued causing damage to a railing that is attached to a staircase inside the residence.
Based upon the foregoing information, there is probable cause to believe that the defendant did commit the crime or offense as stated above.
Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the defendant and bring him/her before the court having jurisdiction.
