Police Log for 07/08/10 – 07/14/10

Three burglaries were reported in Londonderry during this week. The first was reported on July 11, at 7:38 PM. The caller came home to find the apartment had been gone through. The second was reported the following morning at about 5:53 PM. The homeowner arrived home and called police reporting that the burglary had occurred sometime over the weekend. The third burglary was investigated after police responded to a rear sliding door alarm. Upon arrival police found forced entry into the home, and the homeowner was notified. A tow truck was called in to pick up a safe that was found in the yard next to the burglarized home.

This week, three reports of people sleeping in their cars came into the Police Department. On July 8, Police were called to respond to the Boston Express. The caller reported that he had approached a parked vehicle and woke the two males that were inside, asking them to move the car. He also reported to Police that they appeared to be intoxicated. Police arrived, tested the men, who were determined to be sober, and sent them on their way. At about 1:49 AM on July 11, the Wendy’s manager reported a vehicle that had been parked in the parking lot for a few hours. The caller had looked in the vehicle and found a male that had appeared to have either passed out or fallen asleep. Police arrived and spoke with the man, who had just worked a double shift and was taking a nap before driving home. Also on July 11, at about 2 AM, police responded to Garden Lane for a subject sleeping in a car.

Charles Calmes was arrested for Aggravated DWI, among other charges.

Police made 11 arrests this week. Of those, 5 involved alcohol-related charges. On July 9, one subject was charged with two counts of Aggravated Driving While Intoxicated and one count Driving Under the Influence. That same day, a subject was arrested for Transporting Alcohol by a Minor. On July 11, a vehicle was stopped and the driver was arrested for Driving Under the Influence and Driving after Revocation or Suspension. At about 12:43 AM, July 12, another vehicle stop ended in the arrest of a driver who was charged with Disobeying an Officer, Driving Under the Influence, and Driving after Revocation or Suspension. Other charges this week included theft, bench warrants, Failure to Obey Inspection Laws, and Suspended Registration.

I have information that the crime of Conduct After an Accident has been committed by the defendant as follows:
On 05/23/2010 at approximately 0525 hours, Officer Duguay and I responded to Misty Lane for a report of a motor vehicle in the woods, off the roadway. When I arrived, I noted that the black Honda Civic was in the wood line, about 25 feet off of the road. There was no one with the car and it was locked up. The vehicle came back registered to:
John Borden.

It was evident that the vehicle had been travelling west on Litchfield Rd prior to ending up off the road. There was a faint tire mark from the road, to the grass area leading to the woods where the car had crashed. There was also significant damage to the lawn. That morning, Officer Duguay and Sergeant Breen went to Mr. Borden’s home to attempt to make contact with him, which was unsuccessful. The vehicle was towed and held until he contacted me regarding the incident. Later that morning, Officer Duguay did make contact with Mr. Borden, who had been home, and he noted that he smelled the odor of an alcoholic beverage on Mr. Borden’s breath. He denied to Officer Duguay that he had been drinking.
I spoke to Mr. Borden on May 28, 2010. He stated that on that night at around midnight, he was on his way home from his parent’s home in Massachusetts. While on Litchfield Rd, he said that an animal pulled out in front of him and he swerved to the left to avoid it. Mr. Borden was initially unable to give a description of the animal before deciding it was “probably a deer.” He said he lost control of his car and ended up where we found the vehicle. He did notice the lawn damage and said he waited for a half hour before leaving the scene on foot. There were no skid marks indicating an attempt to brake and he could not recall his speed. He did note that he wasn’t going very fast. Mr. Borden stated that he did hit his head somewhere in the car but did not seek treatment. When I asked if he had been drinking alcohol that night, Mr. Borden insisted that he has been sober since October. He was unable to give a reason why there was an odor of an alcoholic beverage on his breath the next morning. When I asked why he didn’t answer the door, he stated that his television in the bedroom is usually loud enough to block out the sound of knocking.
Mr. Borden stated that he thought about contacting the property owner of the lawn the next day but never did. Up until my conversation with him, he made no attempt to contact the property’s owner, BC of Misty Lane. BC provided a statement and confirmed that prior to that evening, the damage to his property was not present.
Based upon the foregoing information, there is probable cause to believe that the defendant did commit the crime or offense as stated above.
Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the defendant and bring him/her before the court having jurisdiction.
